Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Quick-Think Solution SaaS services ("Services") operated by Quick-Think Solution ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Services.

2. Description of Service

Quick-Think Solution provides cloud-based software as a service (SaaS) including ERP, School Management, POS/IMS, and Website Cloud Care solutions. Our Services are designed to help businesses and organizations in Malawi manage their operations more efficiently.

3. Subscription and Billing

Our Services are provided on a subscription basis. You will be billed in advance for the subscription period you choose (monthly, quarterly, or annually). All fees are in Malawian Kwacha (MWK) unless otherwise specified. Payment can be made via Airtel Money, TNM Mpamba, or bank transfer.

Setup fees are one-time charges for onboarding, configuration, and training. These are separate from subscription fees and are non-refundable.

4. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Intellectual Property

The Services and all materials related thereto, including but not limited to software, documentation, and any modifications or derivative works thereof, are the property of Quick-Think Solution and are protected by applicable copyright, trademark, and other intellectual property laws.

6. Data Ownership

You retain ownership of all data you submit to our Services. We do not claim any ownership rights in your data. However, by submitting data to our Services, you grant us a worldwide, royalty-free license to use, copy, transmit, and display such data solely for the purpose of providing the Services to you.

7. Termination

You may terminate your subscription at any time by contacting us. Your access to the Services will continue until the end of your current billing cycle. Upon termination, we will provide you with a final backup of your data.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease.

8. Disclaimer

The Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

In no event shall Quick-Think Solution, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Malawi, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
